1. About These Terms

These Terms of Service ("Terms") govern your use of the MagalufLive website and all bookings made through it. By placing a booking or using our website, you confirm that you accept these Terms and agree to comply with them. If you do not agree, you must not use our website or make any bookings.

Please read these Terms carefully before making a booking. They explain who we are, how we provide our services, how you or we may change or cancel a booking, what to do if there is a problem, and other important information.

2. About Us

MagalufLive is operated by a company registered in England and Wales. Our registered office is in the United Kingdom. You can contact us by email at [email protected].

When we use the words "we", "us" or "our" in these Terms, we mean MagalufLive. When we say "you" or "your", we mean the person making the booking and all persons named on that booking.

3. Our Role as Booking Agent

MagalufLive acts as an intermediary and booking agent between you and third-party event organisers, venues, activity providers and restaurants ("Suppliers"). We facilitate bookings on your behalf, but we do not own, operate, manage or control any of the events, activities, venues or restaurants listed on our website.

Your contract for the actual delivery of the event, activity or dining experience is between you and the relevant Supplier. Our responsibility is limited to arranging and processing your booking with reasonable care and skill. We are not a party to the contract between you and the Supplier, and we do not accept liability for the acts, omissions, defaults or negligence of any Supplier.

Where we sell packages comprising multiple events from different Suppliers, these are sold as a collection of individual event tickets and do not constitute a "package" within the meaning of the Package Travel and Linked Travel Arrangements Regulations 2018.

4. Making a Booking

4.1 Your Agreement

When you make a booking, the lead booker agrees on behalf of all persons named on the booking that they:

  1. have read these Terms and agree to be bound by them;
  2. are at least 18 years of age, and that all persons named on the booking are also at least 18 years of age;
  3. consent to our use of personal data in accordance with our Privacy Policy;
  4. accept financial responsibility for payment of the booking on behalf of all persons named on it; and
  5. where the booking involves age-restricted services, confirm that all members of the party meet the applicable age requirements.

4.2 Booking Confirmation

A binding contract is formed when we send you a booking confirmation email. It is your responsibility to check the confirmation carefully and notify us immediately of any errors. We may not be able to correct mistakes at a later stage.

4.3 If We Cannot Accept Your Booking

If we are unable to accept your booking (for example, because the event is sold out or there is a pricing error), we will inform you in writing and refund any payment you have already made.

5. Prices and Payment

5.1 Pricing

All prices are quoted in British Pounds (GBP) and include any applicable taxes. The price payable is the price shown on our website at the time you place your booking. We take reasonable care to ensure pricing accuracy, but if we discover an obvious error, we will contact you before processing the booking or, if already processed, we may cancel the booking and issue a full refund.

5.2 Event Tickets (Pay in Full)

For individual event tickets, including but not limited to BCM Tickets, White Party, Pirates Reloaded, Gringos Bingo, Oceans Beach Pool Party, MCP Club Pass, Bottomless Brunch, Western Waterpark, Cocktail Class, Jet Skis, Silent Disco and VIP Experience at Mavara Lounge, full payment is required at the time of booking.

5.3 Deposit Bookings (Deposit + Balance)

For certain higher-value bookings, including but not limited to the Magaluf Boat Party, Private Charter Boat, VIP Experience at Mavara Lounge, and Hen Party or Stag Do packages, a non-refundable deposit is required at the time of booking to secure your place. The deposit amount will be clearly communicated to you before you complete your booking.

The remaining balance must be paid no later than four (4) weeks before the date of your event. If you make a booking within four weeks of the event date, full payment is required at the time of booking. If you fail to pay the balance by the due date, we reserve the right to treat the booking as cancelled, and the deposit will be forfeited.

5.4 Restaurant Bookings

Restaurant reservations made through MagalufLive are a free booking service. No payment is taken by us for restaurant reservations. You will pay the restaurant directly for your meal. We are not responsible for the quality, pricing or availability of food and drink at the restaurant.

5.5 Additional Charges

The price of your booking covers only the items specifically listed in the booking confirmation. Any additional costs incurred locally (such as drinks, food, transport, tips or optional extras not included in your booking) are your responsibility and must be paid directly to the Supplier.

6. Cancellation and Refunds

6.1 No Cooling-Off Period

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you do not have a right to cancel your booking within 14 days and receive a refund. This is because our services relate to leisure activities provided on a specific date, which are exempt from the 14-day cooling-off period under Regulation 28(1)(h) of those Regulations.

6.2 Cancellation by You

If you wish to cancel your booking, you must notify us in writing by email to [email protected], quoting your booking reference. The following cancellation charges apply:

6.3 Cancellation or Changes by the Supplier

If a Supplier cancels an event, we will notify you as soon as reasonably practicable and offer you a full refund of all amounts you have paid to us for that event. Alternatively, where available, we may offer you the option to transfer your booking to a different date or a comparable event.

If a Supplier makes a significant change to an event (such as a change of venue, date or time), we will notify you and you may choose to accept the change or receive a full refund. Minor changes (such as changes to the running order, support acts or event timings) do not entitle you to a refund.

6.4 Events You Cannot Attend

We are not responsible for refunding any part of your booking if you are unable to attend an event for any reason, including but not limited to flight cancellations, missed flights, illness, injury, travel disruption, visa issues or personal circumstances. We strongly recommend that you purchase comprehensive travel insurance that covers cancellation.

6.5 How Refunds Are Processed

Where a refund is due, we will process it using the same payment method you used to make the original booking. Refunds are typically processed within 14 days of the refund being approved, although it may take additional time for the funds to appear in your account depending on your payment provider.

7. Changes to Your Booking

If you wish to make a change to a confirmed booking (such as changing the date or transferring a ticket to another person), please contact us by email. We will do our best to accommodate your request, but changes are subject to availability and the policies of the relevant Supplier. An administration fee of up to £10 per change may apply, in addition to any charges imposed by the Supplier.

Some bookings cannot be amended or transferred after confirmation. If a requested change is not possible, you may choose to keep the original booking or cancel it subject to the cancellation charges set out in Section 6.

8. Our Liability

8.1 Our Responsibility as Agent

As a booking agent, our duty is to select Suppliers with reasonable care and skill. We have no liability to you for the actual provision, quality or safety of any event, activity, experience or meal provided by a Supplier, except where it is proved that we failed in our duty to select the Supplier with reasonable care and that this failure directly caused you loss or damage.

8.2 Supplier Liability

The Supplier is responsible for the delivery of the event, activity or experience. Any complaints, claims or disputes relating to the event itself (including but not limited to the quality of entertainment, venue conditions, food and drink, health and safety, and the conduct of staff or other attendees) should be directed to the relevant Supplier. We will, where reasonably possible, assist you in contacting the Supplier.

8.3 Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or business opportunity arising out of or in connection with your booking or attendance at any event. Our total liability to you in respect of any booking shall not exceed the total amount you paid to us for that booking.

8.4 What We Do Not Exclude

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

9. Your Responsibilities

9.1 Behaviour

You are expected to behave in an orderly and responsible manner at all times. If, in the reasonable opinion of a Supplier, venue operator or our representative, your behaviour (or the behaviour of anyone in your party) is causing or is likely to cause distress, danger or disruption to others, or damage to property, the Supplier reserves the right to refuse you entry or remove you from the venue without refund.

9.2 Venue Terms

You must comply with the terms and conditions of each Supplier and venue, including entry requirements, dress codes and age restrictions. It is your responsibility to familiarise yourself with these requirements before attending.

9.3 Travel Insurance

We strongly recommend that you purchase comprehensive travel insurance before travelling to Magaluf. Your policy should cover, at minimum, cancellation, medical expenses, repatriation, personal liability and loss of belongings. If you choose not to purchase adequate insurance, we will not be liable for any losses that insurance would have covered.

9.4 Travel Documents

It is your responsibility to ensure that you hold a valid passport and any required visas for travel to Spain. We accept no responsibility if you are unable to travel or attend an event because you do not hold the correct documentation.

9.5 Health and Safety

Certain events and activities involve physical activity, water-based activities, loud music and other potential risks. You are responsible for assessing your own fitness and suitability to participate. If you have any medical conditions, disabilities or dietary requirements that may affect your participation, you must inform us and the relevant Supplier before the event.

10. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control. This includes, but is not limited to, war, terrorism, civil unrest, natural disasters, epidemics or pandemics, adverse weather conditions, government restrictions, airport or port closures, industrial action, and any other event that could not have been foreseen or avoided.

In such circumstances, we will not be obliged to pay any refund, compensation or cover any costs you incur, except to the extent that we are able to recover funds from the relevant Supplier. This is why we strongly recommend purchasing travel insurance that includes cover for circumstances beyond your control.

11. Intellectual Property

All content on the MagalufLive website, including text, images, logos, graphics, videos and software, is the property of MagalufLive or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify or create derivative works from any content on our website without our prior written consent.

12. Third-Party Links

Our website may contain links to third-party websites, including those of our Suppliers. These links are provided for your convenience only. We do not control and are not responsible for the content, accuracy, privacy practices or availability of any third-party website.

13. Complaints

If you have a complaint about a booking or an event, please contact us by email at [email protected] within 28 days of the event. We will investigate your complaint and respond as soon as reasonably practicable. Where the complaint relates to the event itself, we may need to liaise with the Supplier, which may take additional time.

14. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on our website with a revised "Last updated" date. Your continued use of the website or any booking made after such changes constitutes your acceptance of the revised Terms. We recommend that you review these Terms periodically.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes arising from or in connection with these Terms or your booking shall be subject to the exclusive jurisdiction of the courts of England and Wales. If you live in Scotland, you may bring proceedings in either the Scottish or English courts. If you live in Northern Ireland, you may bring proceedings in either the Northern Irish or English courts.

Nothing in these Terms affects your statutory rights as a consumer under applicable UK or EU law.
